Recital 58
(58) In order to set in place conditions supporting the re-use of documents which is associated with important socio- economic benefits having a particular high value for economy and society, the power to adopt acts in accordance with Article 2901 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of the adoption of a list of high-value datasets among the documents to which this Directive applies, along with the modalities of their publication and re-use. It is of particular importance that the Commission carry out appropriate consultations during its preparatory work, including at expert level, and that those consultations be conducted in accordance with the principles laid down in the Interinstitutional Agreement of 13 April 2016 on Better Law-Making. In The preparaticular, to ensure equal participation in the preparation of delegated acts, the European Parliament and the Council receive all documents at the same on of implementing acts should provide for rights to participation in decision-making and for the financial and human resources for the effectimve as Member States' experts, and their experts systematically have access to meetings of Commission expert groups dealing with the preparation of delegated actuse of such rights; the European social partners should be involved in the preparatory process.

Article 1 – paragraph 4 a (new)
(4a) This Directive leaves intact and in no way affects the level of protection of individuals with regard to the processing of personal data under the provisions of EU and national law, and in particular does not alter the obligations and rights set out in Regulation (EU) 2016/679 (General Data Protection Regulation).

Article 14 – paragraph 2
(2) The power to adopt delegatedimplementing acts referred to in Article 13 shall be conferred on the Commission for a period of five years from [date of entry into force of the Directive]. The Commission shall draw up a report in respect of the delegation of power not later than nine months before the end of the five-year period. The delegation of power shall be tacitly extended for periods of an identical duration, unless the European Parliament or the Council opposes such extension not later than three months before the end of each period. The preparation of implementing acts shall provide for rights to participation in decision-making and for the financial and human resources for the effective use of such rights; the European social partners – stakeholders such as the Austrian Public Sector and Social Economy Association (VÖWG) and the European Centre of Employers and Enterprises providing Public Services of general interest (CEEP) – shall be involved in the preparatory process.
