(60 a) It is necessary to assess and take into account the impact of this Regulation on the economies of the European Neighbourhood countries and developing countries. In order to mitigate possible negative economic and social impacts on countries highly-dependant on phosphate- rock and fertiliser exports, the Commission should take steps necessary to promote recycling and industrial-scale decadmiation technologies and processes in these countries, facilitating compliance with the conditions for CE marking.

(60 b) Due to the high Union dependency on phosphate rock imports, it has been classified as a critical raw material. It is therefore necessary to monitor the impact of this Regulation on the access to raw material supplies, on the availability of phosphate rock and on the prices. After such evaluation, and in case of negative impact, the Commission should take any measures that it deems to be appropriate in order to remedy those disturbances to trade.

Article 40 a Monitoring and assistance to third countries The Commission shall evaluate the impact of this Regulation on the economies of the European Neighbourhood countries and developing countries highly-dependant on phosphate-rock and fertiliser exports. In order to mitigate possible negative impact and facilitate compliance with the conditions for CE marking, the Commission shall take all necessary measures, such as technical and financial assistance, in order to promote recycling and industrial-scale decadmiation technologies and processes in these countries.

Article 40 b Reporting requirements The Commission shall monitor the impact of this Regulation on the security of raw material supplies, the availability of phosphate rock and on prices. The Commission shall present the results of this assessment to the European Parliament and to the Council at latest two years after the date of the entry into force of this Regulation. The Commission shall take any appropriate measure that it deems to be necessary to tackle potential negative impacts .

(15) Certain substances, mixtures and micro-organisms, commonly referred to as plant biostimulants, aredo not as suchprovide nutrients as such, but nevertheless stimulate plants’ natural nutrition processes. Where such products aim solely at improving the plants’ nutrient use efficiency, tolerance to abiotic stress, or crop quality traits, they are by nature more similar to fertilising products than to most categories of plant protection products. They therefore act as a complement to fertilisers, with a view to optimising the efficiency of fertilisers and reducing the amounts used. In addition to boosting production capacity, these products are low-risk for humans and the environment, helping to support ecosystem services and make crops more resistant to the effects of climate change. Such products should therefore be eligible for CE marking under this Regulation and excluded from the scope of Regulation (EC) No 1107/2009 of the European Parliament and of the Council21.
