Takes note that negotiations continue on a separate investment agreement and reiterates that it is unacceptable to return to the old, private ISDS mechanism; Notes that non-discriminatory treatment of foreign investors can be achieved without the inclusion of an ISDS/ICS mechanism; Given the EU’s and the Japan`s developed legal systems such a mechanism is not necessary; Recalls that the Belgian government has asked the ECJ to rule on the compatibility of ICS with the EU legal framework; Therefore asks the Commission to wait until the ECJ has ruled on this matter before negotiations with Japan on investment protection continue;
