3. Points out that transparency and full access to documents held by the institutions have to be the rule, in accordance with Regulation (EC) No 1049/2001 and Regulation (EC) No 1367/2006, and that, as has already been laid down by the precedents consistently set by the EU Court of Justice, exceptions to that rule have to be properly interpreted, taking into account that there is an overriding public interest in disclosure, particularly where the information requested relates to emissions in the environment;

Considers it regretunacceptable that the revision of Regulation (EC) No 1049/2001 is still stalled in the Council and hopes that progress will be achieved as soon as possibleurges the Council to adopt a constructive position, taking into account the Position of the European Parliament adopted at first reading on 15 December 2011 with a view to the adoption of Regulation (EU) No .../2012 of the European Parliament and of the Council regarding public access to European Parliament, Council and Commission documents defining the general principles and limits governing the right of access to documents of Union institutions, bodies, offices and agencies;
