As from 1 November 2014, the Commission shall consist of a number of members, including its President and the High Representativedeleted The members of the Commission shall be chosen from among the nationals of the Member States ofn the Union for Foreign Affairs and Security Policy, corresponding to two thirds of the number of Member States, unless the European Council, acting unanimously, decides to alter this number. Taking into account theFollowing European elections to the European Parliament and after having held the appropriate consultations, the European Council, acting by a qualified majority, acting by a majority of its component members, shall proposnominate to the European ParliamentCouncil a candidate for President of the Commission. This candidate shall be elected by the European Parliament by a majority of its component membersEuropean Union. The European Council, acting by a qualified majority, shall give its consent. If the nominated candidate does not obtain the required majority, the European CouncilParliament, acting by a qualified majority, shall within one month propose a new candidate who shall be elected by the European Parliament following the same procedure. The Council, by common accord with tmajority of its component members, shall within one month nominate a candidate. The European Council, acting by a simple majority, shall give its consent. The President-elect, shall adopt the list of the other personpropose a list of candidates whom it proposes for appointment as members of the CommissionExecutive. They shall be selected, on the basis of the suggestions made by Member States, in accordance with the criteria set out in paragraph 3, second subparagraph, and paragraph 5, second subparagraph. The President, the High Representative of the Union in accordance with the criteria set out in paragraph 3 and 5. The President, the Union Secretary for Foreign Affairs and Security Policy and the other members of the CommissionExecutive shall be subject as a body to a vote of consent by the European Parliament. On the basis of this consent the CommissionExecutive shall be appointed by the European Council, acting by a qualifiedsimple majority.

Annex to the motion for a resolution Treaty on the Functioning of the European Union – Article 113
The Council shall, acting unanimously and in accordance with a special legislative procedure and after consulting the European Parliament and the Economic and Social Committee, adopt provisions for the harmonisation of legislation concerning turnover taxes, excise duties and other forms of indirect taxation to the extent that such harmonisation is necessary to ensure the establishment and the functioning of the internal market and to avoid distortion of competition.

2. By way of derogation from the decision-making procedure provided for in paragraph 1 and without prejudice to Article 114, the Council acting unanimously in accordance with a special legislative procedure and after consulting the European Parliament, the Economic and Social Committee and the Committee of the Regions, shall adopt: (a) provisions primarily of a fiscal nature; (b) measures affecting: — town and country planning, — quantitative management of water resources or affecting, directly or indirectly, the availability of those resources, — land use, with the exception of waste management; (c) measures significantly affecting a Member State's choice between different energy sources and the general structure of its energy supply. The Council, acting with unanimouslity on a proposal from the Commission and after consulting the European Parliament, the Economic and Social Committee and the Committee of the Regions, may make the ordinary legislative procedure applicable to the matters referred to in the first subparagraph.

2. The European Parliament, acting by means of regulations on its own initiative in accordance with a special legislative procedure after seeking an opinion from the Commission and with the consent of the Council, shall lay down the regulations and general conditions governing the performance of the duties of its Members. All rules or conditions relating to the taxation of current Members or former Members shall require unanimity within the Council.
