If there is evidence of repeated or significant cases where economic operators implementing a scheme recognised in accordance with paragraph 1a have failed to fulfil the requirements of this Regulation, the Commission shall examine, in consultation with the operator of the recognised scheme, whether those cases indicate deficiencies in the scheme.
