There is a need to avoid reactive-only measures, therefore the Fund should start its operation before inclusion of at least private households and transport into the scope of directive 2003/87/EC (ETS) so that there is a time to prepare the mostvulnerable transport users and households and to minimise the need of direct income payments. To that end it is desirable that the measures supporting energy efficiency and aimed at improvement of air quality undertaken by Member States are aligned with the purpose of minimising the impact of broadening of the scope of Directive 2003/87/EC.

1. Member States may include the costs of measures providing temporary direct income support to vulnerable households and vulnerable households that are transport users to absorb the increase in road transport and heating fuel prices. Such supportdirect income support shall not exceed 20% of the costs of Member States national plans and shall decrease over time and be limited to the direct impact of the emission trading for buildings and road transport. Eligibility for such direct income support shall cease within the time limits identified under Article 4(1) point (d).

That agreement may be concluded at the earliest one year before the year of the start of the auctions under Chapter IVa of Directive 2003/87/EC.
