(11a) Some illegal acts may be punishable according to this Directive only if they cause or are likely to cause substantial damage to the environment. A starting point for the assessment of the seriousness of a damage should be the objective of the relevant Union legislation that has been infringed. A damage or a likely damage should be considered substantial if it is unacceptable taking into account the level of environmental protection that the relevant Union legislation aim to ensure.
