1a. Member States shall ensure that any distributor who cannot prove that the producer of an electrical or electronic appliance has fulfilled its financial or procedural and technical obligations in respect of that appliance shall himself/herself fulfil those obligations or ensure that they are fulfilled before selling the appliance on.

To establish that the minimum collection rate has been achieved, Member States shall ensure that information on WEEE which: - has been taken to collection facilities in accordance with Article 5(2)(a), - has been taken to distributors in accordance with Article 5(2)(b), - has been separately collected and treated or exported by producers or third parties acting on their behalf, - or has been separately collected and treated, refurbished or exported via any means by other WEEE actor is communicated to them free of charge on annual basis.
