(23a) To ensure consistency with the Aarhus Convention, the present regulation specifies the level of details to which the data collected notably on the use and sales of plant protection and biocidal products must be disseminated proactively by Eurostat. Such publication also aims at minimising the number of access to information requests on the topics related to emissions into the environment and thus at limiting the administrative burden of Eurostat and national authorities confronted with such requests.

(31) This Regulation should apply without prejudice to bothRegulation (EC) 1049/2001, Directive 2003/4/EC (27 ) and Regulation (EC) No 1367/2006 (28 ). 2. A Member State may be exempted from certain regular transmissions of the data where the impact of the Member State on the EU total of a variable is limited. Such exemption cannot apply to the data collected on chemical inputs and nutrient balance as defined at Article5(1)(d), the data on the transition towards minimal use of chemical inputs as defined at Article 5(1)(e). The Commission may adopt implementing acts defining thresholds for variables according to specific methodology in such a way that the application of those thresholds does not reduce the information on the expected EU total of the variable in the reference year by more than 5%. The thresholds shall be revised so that they correspond to the trends of EU totals, initiated by the Commission (Eurostat).

For thatose purposes, the Member States shall request from professional users of plant protection products and biocidal products, in electronic format, records covering at least the name of the plant protection product, the dose of application, the main area and the crop where the plant protection product was used in accordance with this Regulation, per types of crops and species of animals, and per postal code at least the quantities and the name of the active substances used and of the plant protection product and the biocidal product used, the dose of application, the time of application, the surface area where the active substance, plant protection product or biocidal product was used. That information shall be made available to the public.

6. National authorities responsible for complying with the requirements of this Regulation shall have the right to access and use, promptly and free of charge, data, including individual data on enterprises and agricultural holdings in administrative files compiled on their national territory pursuant to Article 17a of Regulation (EC) No 223/2009. Other national authorities that need this data to perform their public mission relating to environmental and public health monitoring and protection from hazardous chemicals, as well as the European Environment Agency shall also have the right to access and use, promptly and free of charge, data, including individual data on enterprises and agricultural holdings in administrative files compiled on their national territory. The national authorities and the owners of the administrative records shall establish the necessary cooperation mechanisms for such access. That access shall also be granted in cases where the competent authority has delegated tasks to be carried out on its behalf to private or semi-public bodies.

Article 10a Publication of data 1. The data collected on the topics listed in Article 5(1)(d), shall be actively disseminated by the Commission (Eurostat) viaInternet, free of charge, at the following level of detail: (a) Per active substance; (b) Per plant protection, biocidal,veterinary medicinal and fertiliser product; (c) Per crop and animal species; (d) Per Postal Code; (e) Per year. 2. The data collected under this regulation onother topics than those listed at paragraph 1 shall be actively disseminated bythe Commission (Eurostat) excluding confidential data in accordance with Regulation(EC) 223/2009 read in conjunction with Regulation (EC) No 1367/2006. 3. This regulation is without prejudice tothe right of public access to documents under Regulation (EC) No 1049/2001 readin conjunction with Regulation (EC) No 1367/2006 and Directive 2003/4/EC.

1. Where the application of this Regulation or of the implementing measures and delegated acts adopted pursuant to them necessitates major technical adaptations in a national statistical system of a Member State, the Commission may adopt implementing acts granting derogations to Member States for a maximum duration of two years, non- renewable. The notion of necessary major technical adaptations in a national statistical system of a Member State must be interpreted strictly. Such derogation cannot apply to the data collected on chemical inputs and nutrient balance as defined at Article 5(1)(d), the data on the transition towards minimal use of chemical inputs as defined at Article5(1)(e).
