Recital J a (new)
Recital J a (new)
Ja. whereas number of countries or regions in the EU and globally have banned transport of live animals on long distances to third countries and overseas and others are considering the measure due to proving impossibility for the transport to be held in line with the provisions of the Regulation (EC) No 1/2005 as well as due to impossibility to assess the real conditions during long distance journeys to third countries;
Amendment 123 #

Amendment 126 #
Motion for a resolution
Paragraph 1 a (new)
Paragraph 1 a (new)
1a. Emphasises, that the transport regulation was adopted more than 15 years ago and that it does not set the conditions in line with the most recent scientific research and knowledge on the physiology and needs of the animals;
Amendment 128 #
Motion for a resolution
Paragraph 1 b (new)
Paragraph 1 b (new)
1b. Is concerned that the current provisions of the Regulation (EC) No 1/2005 are not aligned with the Farm to Fork Strategy to promote a local and short supply chains and stresses that the systematic regulatory changes of live animal transports are needed to shift the trade from live transports to transports of meat, carcasses and genetic material;
Amendment 136 #
Motion for a resolution
Paragraph 3
Paragraph 3
3. Recalls that the Commission, in its 2011 report on the impact of Regulation (EC) No 1/2005, identified the enforcement of the regulation as a major challenge, partly because of differences in the interpretation of the requirements and partly because of the lack of controls by the Member States, while the 2020 reports on welfare of animals exported by road and sea emphasized that the limitations, such as inability of Member States to ascertain the conditions of transport outside the EU or during the sea travel and routinely unreported approvals of incomplete and incorrect travel documentation, prevent national authorities and the Commission to get an overview of the general situation during these transports and to target their controls more effectively and based on risk;
Amendment 150 #
Motion for a resolution
Paragraph 4 a (new)
Paragraph 4 a (new)
4a. Stresses that provisions for transport of Equidae and companion animals are vague and severely lacking, which leads to frequent breaches of the regulation and serious animal welfare problems; underlines that registered horses are exempt from a variety of provisions, further hindering their welfare; moreover, many technical requirements set out in the regulation are incompatible with the needs of Equidae;
Amendment 154 #
Motion for a resolution
Paragraph 4 b (new)
Paragraph 4 b (new)

Paragraph 9
Paragraph 9
9. Acknowledges the letters sent by the Commission, in the framework of the Farm to Fork strategy, asking Member States to ensure immediate and full compliance with EU requirements, including on animal welfare during transport, and expressing its determination to take legal action in the event of systematic non-compliance; notes that no infringements proceedings have been opened by the Commission against any Member State, which should be made in the case of non-compliance;
Amendment 221 #
Motion for a resolution
Paragraph 10
Paragraph 10
10. Notes that the most frequently documented violations during road transports are linked to the lack of headroom and space, animals being unfit for transport, overcrowding, transport during extreme temperatures and journey durationanimals’ dehydration due to inappropriate watering devices or lack or water supply transport during extreme temperatures and journey duration, disregard for the CJEU ruling C-424/13, non-realistic journey logs and non-feasible contingency plan; additionally notes that the communication on findings from official controls between competent authorities from different Member States remains poor; stresses that these violations are greatly facilitated by weak enforcement measures by authorities and by too little controls (quantitative and qualitative); stresses that sanctions are too weak, not dissuasive and not harmonised;
Amendment 228 #
Motion for a resolution
Paragraph 10 a (new)
Paragraph 10 a (new)
10a. Notes that the most frequently documented violations on transport by sea are lack of knowledge by the competent authorities when inspecting livestock, lack of trained personnel handling the animals on the vessel, lack of legislated temperature and humidity requirements during the sea transport and lack of contingency plans for transporters as well as for competent authorities;
Amendment 251 #
Motion for a resolution
Paragraph 14
Paragraph 14
14. Takes note of several reports of incorrect handling during animal loading and unloading, causing unnecessary stress and suffering; stresses that proper animal handling results in shorter loading and unloading times, reduced weight loss, fewer injuries and wounds and, ultimately, better meat quality; underlines that the risk for AMR increases when animals are transported in close and stressful spaces;
Amendment 264 #
Motion for a resolution
Paragraph 16
Paragraph 16
16. Stresses that according to Regulation (EC) No 1/2005, the farmer, the driver and transport companies share equal responsibility for assessing whether animals are fit for transport; notes that the most common breaches in this respect concern the transport of pregnant animals, animals more than 90 % of the way through gestation, which sometimes give birth on board, downers (with physiological weakness and/or wounds or a pathological condition), and animals with wounds or prolapseimals with wounds or prolapses, end of career animals and unweaned animals, while stresses that pregnant, unweaned as well as end of career animals are particularly vulnerable animal categories with special needs and that provisions in the transport regulation do not reflect species, age and status specific needs according to the latest scientific knowledge and recommendations also in the context of maximum duration of transport of these animals;

Paragraph 25
Paragraph 25
25. Notes that the vehicles used for transporting animals inside and outside the Union are often not equipped with air cooling systems; highlights that though air ventilation systems move the air through the animal compartment, the temperature inside the vehicle will nevertheless mainly reflectexceed the external temperature, in particular when the vehicle is stationary due to additional body-heating of the animals and overheating in the sun and that this is not sufficiently reflected in the regulation;

Paragraph 48
48. Stresses the vulnerability of unweaned animals and that the current minimum age for the transport of calves is too low; believes that the minimum age of very young animals should be corrected to a minimum age of being unweaned, meaning being able to feed on solid feed and drink water of drinkers working with over pressure method; highlights that, according to various experts and the former sub-group of the EU Animal Platform on Animal Welfare, more scientific evidence is needed to support good practices in the long-distance transport of unweaned animals and that the current provisions of Regulation (EC) No 1/2005 are not adapted to the needs of these animals;

Paragraph 50
Paragraph 50
50. Recalls the Commission’s recommendations from 2009 to the competent authorities to ensure that unweaned animals are offered electrolytes or milk substitutes during the resting period and pointing out that metal nipples should not be considered, stresses however the expert recommendations that unweaned animals should not be transported and that electrolytes can’t replace the milk substitutes which is the only suitable feed substitute for unweaned animals and the limitation of the proper and natural intake for unweaned animals leads to rapid deterioration of the immunity systems of these animals, points out in addition that the common drinking devices are not suitable for unweaned calves; notes that feeding unweaned animals during their journey in lorries is currently technically impracticable and that other innovative solutions are neededossible;
