(4) Regulation (EC) No 1005/2009 of the European Parliament and of the Council18 ensures, inter alia, that the Union complies with the Protocol. By 1 January 20330, the Commission shall publishresent a report on the implementation of this Regulationto the European Parliament and to the Council on the implementation of this Regulation. The Commission shall assess in particular the availability of alternatives to ozone depleting substances for which a derogation is granted under Articles 6, 7, 8 and 9. The Commission shall also assess the impact of this Regulation on the fight against the illegal trade of ozone depleting substances. Following the presentation of this report and the assessments requested, the Commission may, if appropriate, submit a legislative proposal.
