Stresses that freedom of expression and the independence and pluralism of the media are prerequisites for democracy and cultural diversity, as set out in Article 11 of the Charter of Fundamental Rights, and that it is essential for the European institutions to ensure that Member States comply therewith, especially since they are bound in this respect by a positive obligation arising from the interpretation, by the European Court of Human Rights, of Article 10 of the European Convention for the Protection of Human Rights;
