Article 3 – paragraph 1 – point 19 a (new)
(19a) 'best available techniques' means the most effective and advanced stage in the development of activities and their methods of operation which indicates the practical suitability of particular techniques for providing the basis for emission limit values and other permit conditions designed to prevent and, where that is not practicable, to reduce emissions and the impact on the environment as a whole: - 'techniques' includes both the technology used and the way in which the installation is designed, built, maintained, operated and decommissioned; - 'available techniques' means those developed on a scale which allows implementation in the relevant industrial sector, under economically and technically viable conditions, taking into consideration the costs and advantages, whether or not the techniques are used or produced inside the Member State in question, as long as they are reasonably accessible to the operator; - 'best' means most effective in achieving a high general level of protection of the environment as a whole;

Article 5 a Exchanges of information and review of emission limit values The Commission shall organize an exchange of information on best available techniques between Member States and the Commission. The Commission shall initiate the exchanges of information by 1 January 2023, and hereafter every tenth year. The Commission shall on the basis of the information on best available techniques review the need to amend the emission limit values set out in Annex II, part 1 and 2. The Commission shall report the results of this review to the European Parliament and to the Council accompanied, if appropriate, by a legislative proposal.
