(10 a) Such a financial contribution should also include a situation where the beneficiary has privileged access to its domestic market, for example through exclusive or special rights or equivalent measures, for the provision of goods or services in the third country conferred by national law or the benefit of a domestic captive market due to the prevailing legal and economic conditions. This could lead to a competitive advantage that could be leveraged in the EU internal market and thereby exacerbate the distortive effect of any subsidy.
