(2 a) Considers that, in order to maintain the competitiveness of European industry and avoid the relocation of companies in third countries, the EU long term targets for the reduction of fluorinated gas emissions should be applied upon the approval of an international agreement on HFC reduction within the UNFCCC or the Montreal Protocol.

(2 b) The increase in the use of fluorinated greenhouse gases has served the objective of substituting other substances depleting the ozone layer. They currently represent only 2% of the overall greenhouse gas emissions in the EU. They are mainly used in the regions of the EU with warmer climate conditions. If the targets are not set in a balanced way, the companies in some Member States will have to face a heavier burden than in others.

(7) ‘hermetically sealed system’ means a system in which all parts that contain fluorinated greenhouse gases have been hermetically sealed during their manufacturingrefrigerant containing parts have been made tight by welding them, brazing them or otherwise making them tight byor a similar permanently connecting them and for which the refrigerant circuit does not need to be opened for placing the system into operationon which may include capped valves and capped service ports that allow proper repair or disposal and which have a tested leakage rate of less than 3 grams per year under a pressure of at least a quarter of the maximum allowable pressure;

3. The use of fluorinated greenhouse gases, or of mixtures that contain fluorinated greenhouse gases, with a global warming potential of 2500 or more, to service or maintain refrigeration equipment with a charge size equivalent to 50 tonnes of CO2 or more, shall be prohibited from 1 January 20205. This provision shall not apply to: - equipment intended for applications operating below -50°C; - reclaimed fluorinated greenhouse gases with a global warming potential of 2500 or more used for the maintenance or servicing of existing refrigeration equipment,; - recycled fluorinated greenhouse gases with a global warming potential of 2500 or more used for the maintenance or servicing of existing refrigeration equipment; or - equipment for which it has been established in ecodesign requirements adopted under Directive 2009/125/EC, on the ecodesign requirements for energy - related products, that due to higher energy efficiency during its operation its lifecycle CO2 emissions would be lower than that from equivalent equipment which meets relevant ecodesign requirements and does not contain hydrofluorocarbons.
