1. Stresses that any European digital trade strategy or provisions for cross- border data flows andCalls on the Commission to ensure that cross-border data transfers are in compliance with the existing and future EU legal framework, in particular through adequacy decisions, and to incorporate in our trade agreements on afirst and foree flow legal provision should fully respect the EU data protection acquis and comply with EU fundamental rights standards; most a horizontal provision, which fully maintains the right of a Party to protect personal data and privacy, with the only condition that it must not be used with the intention to restrict data flows for reasons other than the protection of personal data, accompanied with a second provision, which prevents unjustified requirements for data localisation;

Emphasises that digital trade is best facilitated through an open exchange of data, with no geographical restrictions; considers that the removal of data localisation requirements should be a top priority, while emphasising that the relevant data protection legstresses the need to ensure that cross- border transfers of personal data are in compliance with the existing and future EU legal framework, in particular through adequacy decisions; calls above all for the inclusion in EU trade agreements of a horizontal provision which fully maintains the right of a Party to protect personal data and privacy, with the only condition that it must not be used with the intention to restrict data flows for reasons other than the protection of personal data; considers that the removal of unjustified data localislation should be adhered torequirements should also be a top priority, and therefore calls for the inclusion in EU trade agreements of a second provision preventing unjustified requirements for data localisation;
