(12) Before a work can be considered an orphan work, a good faith and reasonable diligent search for the authorits right holders should be carried out. Member States should be permitted to provide that such a diligent search may beprovide that the organisations referred to in this Directive are given the choice of either carrying out such a diligent search by their own means or having it carried out by other organisations referred to in this Directive or by other organisation, including collecting societies.

(22a) Member States should, in conjunction with different stakeholders in the content creation and rights ownership chain, implement a policy to prevent works from becoming orphan works, in order to limit the appearance of orphan works and reduce their number. Effective identification of works, exchanges of information on orphan works, and promotion of collective management or extended collective management are necessary in order to prevent the appearance of orphan works.
