Calls, moreover, for any notice and action procedure to comply with minimum formal requirements, making it compulsory to inform the uploader about a notification, the further procedure and possibilities of objection, and making provision for an independent dispute settlement procedure; the addressed provider must examine the merits of the complaint by seriously attempting to ascertain the facts needed in order to weigh up the interests of all the parties involved; a purely formal examination is not sufficient;
