Recital 9
(9) This Directive respects the fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union. In particular, this Directive seeks to ensure full respect for the rights of persons with disabilities to benefit from measures designed to ensure their independence, social and occupational integration and participation in the life of the community and to promote the application of Article 26 of the Charter of Fundamental Rights of the European Union and the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD).

Recital 22 a (new)
(22a) Certain elements of the accessibility requirements laid down by this Directive, particularly those set out in Annex I relating to the provision of information, are already covered by existing legislative acts of the Union in the area of transport. Those acts include Regulations (EC) Nos 1371/20071a and (EU) 1300/2014 of the European Parliament and of the Council1b and Commission Regulation (EU) No 454/20111c as regards rail transport; Regulation (EU) No 181/2011 of the European Parliament and of the Council1d as regards bus and coach transport; and Regulation (EU) No 1177/2010 of the European Parliament and of the Council1e as regards maritime transport. To ensure regulatory consistency and predictability for the economic operators covered by those acts, the relevant requirements under this Directive should be deemed to be complied with where the relevant parts of those acts are complied with. (22b) The determination of the scope of this Directive with regard to air, bus, rail and waterborne passenger transport services should be based on the existing sectoral legislation relating to passenger rights. Where this Directive does not apply to certain types of transport services, Member States should be able to encourage service providers to apply the relevant accessibility requirements provided for in this directive.
