PURPOSE: The Conclusion of a Protocol on the fishing off the coast of the Cote d'Ivoire between the EEC and the Republic of Cote d'Ivoire.
LEGISLATIVE ACT: Council Regulation 953/2005/EC relating to the conclusion of the Protocol setting out, for the period from 1 July 2004 to 30 June 2007, the fishing opportunities and financial contribution provided for in the Agreement between the European Economic Community and the Republic of Côte d’Ivoire on fishing off the coast of Côte d’Ivoire.
CONTENT: The Protocol setting out, for the period from 1 July 2004 to 30 June 2007, the fishing opportunities and financial contribution provided for in the Agreement between the European Economic Community and the Republic of Côte d’Ivoire on fishing off the coast of Côte d’Ivoire is hereby approved on behalf of the Community.
The fishing opportunities set out in the Protocol shall be allocated among the Member States as follows:
(a) demersal species:
Spain : 1 300 GT (gross tonnage) per month, averaged over the year;
(b) tuna fishing vessels:
(i) tuna seiners:
- France: 17 vessels,
- Spain: 17 vessels;
(ii) surface longliners:
- Spain: 6 vessels,
- Portugal: 5 vessels;
(iii) pole-and-line tuna vessels:
- France: 3 vessels.
If licence applications from these Member States do not exhaust the fishing opportunities set out in the Protocol, the Commission may consider licence applications from any other Member State.
Member States that have vessels fishing under the present Agreement shall notify the Commission, in accordance with Commission Regulation (EC) No 500/2001 of 14 March 2001 laying down detailed rules for the application of Council Regulation (EEC) No 2847/93 on the monitoring of catches taken by Community fishing vessels in third country waters and on the high seas, of the quantities of each stock taken in the Côte d’Ivoire fishing zone.
ENTRY INTO FORCE: 27/06/2005.
The European Parliament adopted a resolution drafted by Philippe MORILLON (ALDE, FR) and made some amendments to the Commission’s proposal, stating that the protection of the EU's interests in the field of fisheries must be coordinated with the sustainable management of fishery resources in economic, social and environmental terms, and with the sustainable development of coastal populations dependent on fisheries. The principal amendments were as follows:
- during the final year of the Protocol’s validity and before another agreement is concluded on its renewal, the Commission must submit to the European Parliament and to the Council a report on the application of the agreement and the conditions under which it was implemented;
- o n the basis of this report and after consulting the European Parliament, the Council may grant the Commission a negotiating mandate with a view to the adoption of a new protocol;
- each year the Commission will forward to the European Parliament and to the Council the report on the targeted measures which the Côte d’Ivoire authorities are to supply in accordance with the protocol.

CONTENT : On 30 June 2003 the Protocol to the Fisheries Agreement between the EC and the Republic of the Cote d'Ivoire expired. Likewise on 30 June 2004 an Agreement extending the Protocol expired. When re-negotiating the terms of the Protocol the Joint Committee accepted the need to amend the provisions of the Protocol to take account of the new fisheries policy overall and in particular relations towards non-member countries. The new Protocol, which was initialled in Brussels on 3 March 2004, covers a period of three years from 1 July 2004 to 30 June 2007. It grants fishing opportunities on an annual basis amounting to 1 300 GT per month on average each year for demersal trawlers, for 34 tuna seiners, 11 surface longliners and 3 pole-and-line tuna vessels. The financial contribution is EUR 1 065 000 per year. In addition, both sides have agreed:
- On the need to concentrate efforts on control, monitoring and on scientific research to promote a sustainable fisheries policy.
- The setting up of a scientific committee to monitor fisheries resources. And,
- A new exclusivity clause and social clause.
The Commission proposes that the Council adopt the Protocol on the basis of a Regulation. The provisional application of the new Protocol will be based on a draft Council Decision, pending it definitive entry into force, which is the subject of a separate procedure.
FINANCIAL IMPLICATIONS:
- Budget lines and headings: 110301 (ex B78000) : International Fishing Protocols; 11010404 (ex B78000A) : International Fishing Protocols - Expenditure on administrative management.
- Overall figures: Total allocation for action (Part B) a minimum of EUR 3.424.125 and a maximum of EUR 6.619.125 in commitment appropriation and payment appropriations.
- Period of application: 01/07/2004 – 30/06/2007.
- Overall financial impact of human resources and other administrative expenditure: A total of three full time staff, of which 1 grade A, 1 grade B and 1 grade C and two part-time staff.
