CONTENT : the Council adopted a Regulation imposing restrictive measures directed against certain persons and entities in view of the situation in Côte d'Ivoire. This Regulation seeks to transpose into Community law the restrictive measures decided on by the United Nations Security Council in Resolution 1572(2004) concerning the freezing of funds and economic resources of certain persons and entities who constitute a threat to the peace and reconciliation process in Côte d'Ivoire.
ENTRY INTO FORCE : 14 April 2005.
The European Parliament adopted the report by Jean-Marie CAVADA (ALDE, FR) on imposing certain specific restrictive measures directed against certain persons and entities in view of the situation in Côte d’Ivoire.
Parliament adds that the African Union Summit has recently renewed the mandate conferred on Thabo Mbeki, President of South Africa, asking him to secure a resumption of the implementation of the peace agreement signed by the parties to the conflict. It also stipulates that the measures provided for in this Regulation are without prejudice to the adoption of other measures aimed at implementing the Linas-Marcoussis and Accra III Agreements, in particular the obligation to prosecute and try, in accordance with the provisions of international human rights conventions, persons suspected of committing serious violations of human rights and international humanitarian law, and at opening an investigation by the Prosecutor of the International Criminal Court into the situation in Côte d'Ivoire, on the basis of the ad hoc referral to the Court by the Ivorian authorities on 1 October 2003, pursuant to Article 12 of the Rome Statute.
Lastly, Parliament highlights that natural or legal persons, entities or bodies whose funds and economic resources have been unjustly frozen shall be reimbursed with an amount the type and quantity of the prejudice unjustly suffered. Any information provided or received shall be used only for the purposes for which it was provided or received and only for the period necessary for the assets to be frozen and shall be subject to rules guaranteeing data protection.

PURPOSE :to impose certain specific restrictive measures directed against certain persons and entities in view of the situation in Côte d'Ivoire.
PROPOSED ACT : Council Regulation.
PURPOSE : in view of recent developments in Côte d'Ivoire, and notably the resumption of hostilities and repeated violations of the ceasefire agreement of 3 May 2003, the United Nations Security Council decided on 15 November 2004 to impose certain restrictive measures against Côte d'Ivoire.
The restrictive measures decided by the Security Council in its Resolution 1572 (2004) include, inter alia, the application as of 15 December 2004 of the freezing of funds and economic resources of persons designated by the United Nations as constituting a threat to the peace and national reconciliation process in Côte d'Ivoire.
The freezing of funds and economic resources of designated persons falls within the scope of the Treaty. The Commission proposes to implement it by means of a Council Regulation.
The proposed measures are similar to those imposed by means of Regulation 881/2002/EC imposing certain specific restrictive measures directed against certain persons and entities associated with Usama bin Laden, the Al-Qaida network and the Taliban, and by Regulation 1763/2004/EC imposing certain restrictive measures in support of effective implementation of the mandate of the International Criminal Tribunal for the former Yugoslavia (ICTY) (refer to CNS/2004/0114).
