PURPOSE: adaptation to the regulatory procedure with scrutiny of 46 instruments subject to the co-decision procedure ("Omnibus" Regulation, Part Four).
LEGISLATIVE ACT: Regulation (EC) No 596/2009 of the European Parliament and of the Council adapting a number of instruments subject to the procedure referred to in Article 251 of the Treaty to Council Decision 1999/468/EC with regard to the regulatory procedure with scrutiny — Adaptation to the regulatory procedure with scrutiny — Part Four.+
CONTENT: Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission was amended by Decision 2006/512/EC, which introduced the regulatory procedure with scrutiny for the adoption of measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the procedure laid down in Article 251 of the Treaty, inter alia, by deleting some of those elements or by supplementing the instrument with new non-essential elements.
This regulation covers 46 legislative acts to be adapted to the new regulatory procedure with scrutiny (the list of acts is annexed to the proposal). The amendments that need to be made to instruments for this purpose concern only the committee procedures and so, in the case of Directives, do not require transposition by the Member States.
ENTRY INTO FORCE: 07/08/2009.
The European Parliament adopted by 604 votes to 24 with 10 abstentions, a legislative resolution amending the proposal for a regulation of the European Parliament and of the Council adapting a number of instruments subject to the procedure referred to in Article 251 of the Treaty to Council Decision 1999/468/EC, as amended by Decision 2006/512/EC, with regard to the regulatory procedure with scrutiny - Adaptation to the regulatory procedure with scrutiny - Part Four.
The report had been tabled for consideration in plenary by József SZAJER (EPP-ED, HU), on behalf of the Committee on Legal Affairs.
The amendments were the result of a compromise between the Council and the Parliament.
It is recalled that 42 instruments are covered by this proposal which seeks to adapt these instruments to the regulatory procedure with scrutiny. The compromise text has extended in a few cases those transitional measures of general scope and implementing measures that must be adopted using the regulatory procedure with scrutiny.
In one or two cases, the time-limits within which the European Parliament and the Council may oppose a draft measure, have been curtailed in some provisions of the basic acts.
The Committee on Legal Affairs adopted the report drafted by József SZAJER (EPP-ED, HU) and made some amendments to the proposal for a regulation of the European Parliament and of the Council adapting a number of instruments subject to the procedure referred to in Article 251 of the Treaty to Council Decision 1999/468/EC, as amended by Decision 2006/512/EC, with regard to the regulatory procedure with scrutiny – Adaptation to the regulatory procedure with scrutiny – Part Four.
The Rapporteur proposed to other committees that the alignment packages should be adopted as soon as possible, in order for the RPS procedure to start applying to the existing acquis before the entry into force of the Treaty of Lisbon (which contains important provisions on delegated acts, which will replace RPS, but which will take time to be adopted via codecision). The present Report contains several amendments that were suggested by other committees in their opinions, received in form of letters, as well as amendments relating to the dossiers of the Committee on Environment, Public Health and Food Safety.
