PURPOSE: to recast Directive 71/316/EEC in order to make adjustments for the regulatory procedure with scrutiny.

LEGISLATIVE ACT: Directive 2009/34/EC of the European Parliament and of the Council relating to common provisions for both measuring instruments and methods of metrological control (recast).

CONTENT: the codification of Directive 71/316/EEC on the approximation of the laws of the Member States relating to common provisions for both measuring instruments and methods of metrological control has been initiated by the Commission. The new Directive was to have superseded the various acts incorporated in it.

In the meantime Council Decision 1999/468/EC laying down the procedures for the exercise of implementing powers conferred on the Commission has been amended by Decision 2006/512/EC, which introduced a regulatory procedure with scrutiny for measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the procedure referred to in Article 251 of the Treaty, including by deleting some of those elements or by supplementing the instrument by the addition of new non-essential elements.

Consequently, the codification of Directive 71/316/EEC has been transformed into a recast in order to incorporate the amendments necessary for the adjustment to the regulatory procedure with scrutiny.

Under the terms of the new Directive, the Commission will be empowered to amend Annexes I (EC pattern approval) and II (EC initial verification) to this Directive and the annexes to the separate Directives.

The measures necessary for the implementation of this Directive should be adopted in accordance with the regulatory procedure with scrutiny.

ENTRY INTO FORCE: 18/05/2009.

The European Parliament adopted, by 581 votes to 12 with 17 abstentions, a legislative resolution approving the proposal for a directive of the European Parliament and of the Council relating to common provisions for both measuring instruments and methods of metrological control (recast).

The report had been tabled for consideration in plenary by József SZAJER (EPP-ED, HU) on behalf of the Legal Affairs Committee.

The Commission's proposal was approved as adapted to the recommendations of the Consultative Working Party of the Legal Services of the European Parliament, the Council and the Commission.

The Legal Affairs Committee adopted a report drawn up by József SZAJER (EPP-ED, HU) and unanimously approved, in 1 st reading of codecision procedure, the proposal for a directive of the European Parliament and of the Council relating to common provisions for both measuring instruments and methods of metrological control (recast).
