PURPOSE: final adoption of amending budget No 2 of the European Union for the financial year /2009.

LEGISLATIVE ACT: Decision 2009/456/EC, Euratom.

CONTENT: the European Parliament finally adopted amending budget No 2/2009 of the European Union, in accordance with its resolution of 22 April 2009 (please see the summary of the resolution).

This amending budget covers the following items:

the establishment plans of the Single European Sky ATM Research (SESAR) Joint Undertaking and the European Centre for Disease Prevention and Control (ECDC); the modification of the European Railway Agency (ERA); the modification of the budget remarks for "Global Monitoring for environment and Security" (GMES) Preparatory Action.

The European Parliament adopted by 646 votes to 24, with 7 abstentions, a resolution aimed at approving, unamended, draft amending budget No 2/2009 of the European Union for the financial year 2009.

The European Parliament recalls that this draft amending budget covers the following items:

the establishment plans of the Single European Sky ATM Research (SESAR) Joint Undertaking and the European Centre for Disease Prevention and Control (ECDC); the modification of the European Railway Agency (ERA); the modification of the budget remarks for "Global Monitoring for environment and Security" (GMES) Preparatory Action.

The Parliament also recalls that the purpose of draft amending budget No 2/2009 is to formally enter these budgetary adjustments into the 2009 budget.

The Committee on Budgets unanimously adopted the report drawn up by Jutta HAUG (PES, DE), approving unamended draft amending budget No 2/2009 of the European Union for the financial year 2009, recalling that it covers the following items:

the establishment plans of the Single European Sky ATM Research (SESAR) Joint Undertaking, and the European Centre for Disease Prevention and Control (ECDC); the modification of the European Railway Agency (ERA); the modification of the budget remarks for "Global Monitoring for environment and Security" (GMES) Preparatory Action.

MEPs also recall that the purpose of Draft amending budget No 2/2009 is to formally enter these budgetary adjustments into the 2009 budget.

On 2 February 2009, the Commission forwarded to the Council preliminary draft amending budget (PDAB) No. 2 to the general budget for 2009, which contains the following elements:

inclusion of the establishment plan of the SESAR Joint Undertaking subsequent the modification of Council Regulation (EC) No. 219/2007 of 27 February 2007 on the establishment of a Joint Undertaking to develop the new generation European air traffic management system (SESAR); modifications to the establishment plan of the European Centre for Disease Prevention and Control (ECDC) subsequent the adoption of the 2009 budget wherein the reserve on the Centre's budget was lifted; technical adjustment to the establishment plan of the European Railway Agency (ERA) in accordance with the 2009 budget; update of the budgetary remarks of Article 02 02 11 (Preparatory Action – GMES operational services) and Item 21 01 04 05 (Facility for rapid response to soaring food prices in developing countries - Expenditure on administrative management).

The changes proposed in PDAB No. 2/2009 do not affect the general statement of revenue for the 2009 budget.

On 26 February 2009, the Council established draft amending budget No. 2 for the financial year 2009, as submitted by the Commission in its Preliminary draft amending budget No. 2 and as set out in the technical annex to this explanatory memorandum of the Council’s draft budget (see Council doc. 6953/09 ADD 1 ).

PURPOSE: to present the p reliminary draft amending budget ( PDAB ) No 2 for the year 2009 .

CONTENT: the preliminary draft amending budget No 2/2009 covers the following elements:

SESAR (the inclusion in the Community budget of the establishment plan of the SESAR Joint Undertaking: the SESAR Joint Undertaking is already operational and has already recruited some initial staff. In order to ensure continuity of the SJU operations, a seamless transition of the existing staff to an EC statute and the completion of its recruitment process within 2009, is essential. It is therefore necessary to include the SJU's establishment plan in the Community budget as from the beginning of the 2009 exercise. European Centre for Disease Prevention and Control (ECDC) (modifications to the establishment plan of the ECDC, coherent with the 2009 budget: the ECDC is a decentralised "1 st pillar" agency based in Stockholm and tasked with monitoring, assessing and communicating threats to human health from communicable diseases. The present preliminary draft amending budget is justified by the need to amend its establishment plan in coherence with the decisions taken by the Budget Authority in the 2009 budget (allocation of 40 additional temporary agents). European Railway Agency (ERA) (modifications to the establishment plan of the ERA): the establishment plan 2009 as authorised under the Community budget does not fully reflect the needs of the Agency as far as its extended competences under Regulation (EC) No 1335/2008 of 16 December 2008 and its staff policy. The establishment plan needs to be amended to provide: i) an AD15 post for the Executive Director which was erroneously deleted from the establishment plan in the 2009 budget; ii) 3 additional AST posts, with a corresponding reduction of 3 AD posts, to allow an appropriate level of administrative support for the operational activities of the Agency.

PDAB 2/2009 provides for modifications to the budget remarks.

It has no financial consequences .
