PURPOSE: to conclude, on behalf of the Union and its Member States, a Protocol amending the Air Transport Agreement between Canada and the European Community and its Member States to take account of Croatia's accession to the European Union.

NON-LEGISLATIVE ACT: Council Decision (EU) 2019/704 on the conclusion, on behalf of the Union and its Member States, of a Protocol amending the Agreement on Air Transport between Canada and the European Community and its Member States, to take account of the accession to the European Union of the Republic of Croatia.

CONTENT: the Council adopted a Decision on the approval, on behalf of the Union, of the Protocol amending the Air Transport Agreement between Canada and the European Community and its Member States to take account of Croatia's accession to the European Union.

The EU-Canada Air Transport Agreement was initialled on 30 November 2008, endorsed by the EU-Canada summit on 6 May 2009, signed on 17-18 December 2009; subject to its conclusion at a later date. The Agreement is a comprehensive air transport agreement that includes a gradual phasing-in of traffic rights and investment opportunities, as well as a far reaching cooperation on a number of issues including safety, security, social matters, consumer interests, environment, air traffic management, state aids and competition.

The Protocol was signed subject to its conclusion. Under this Protocol, Croatia becomes a party to the Agreement. The Protocol outlines the linguistic adaptations to be made to the Agreement by reason of Croatia's accession.

Details

The European Parliament adopted by 668 votes to 14, with 22 abstentions, a legislative resolution on the draft Council decision on the conclusion, on behalf of the Union and its Member States, of a Protocol amending the Agreement on Air Transport between Canada and the European Community and its Member States, to take account of the accession of the Republic of Croatia to the European Union.

Parliament gave its consent to the conclusion of the protocol.

The purpose of the Protocol is to enable Croatia to become a Party to the Agreement on Air Transport between Canada, of the one part, and the European Community and its Member States, of the other part, and to provide for the necessary ensuing linguistic adaptations made to the Agreement due to Croatia's accession. The Protocol makes no substantial amendments to the Agreement between the European Union and Canada.

The Committee on Transport and Tourism adopted the report by Francisco ASSIS (S&D, PT) on the draft Council decision on the conclusion, on behalf of the Union and its Member States, of a Protocol amending the Agreement on Air Transport between Canada and the European Community and its Member States, to take account of the accession to the European Union of the Republic of Croatia.

The committee recommended that the European Parliament give its consent to the conclusion of the protocol.

The EU-Canada Air Transport Agreement was initialled on 30 November 2008, endorsed by the EU-Canada Summit on 6 May 2009 and signed on 17-18 December 2009, subject to its conclusion at a later date.

This comprehensive agreement provides for the gradual phasing-in of traffic rights and investment opportunities as well as far-reaching cooperation in several areas, including safety, security, social issues, consumer interests, environment, air traffic management, state aid and competition.

Details

ROLE OF THE EUROPEAN PARLIAMENT: Council may adopt the act only if Parliament has given its consent to the act.

BACKGROUND: the Protocol amending the Agreement on Air Transport between Canada and the European Community and its Member States, to take account of the accession to the European Union of Croatia has been signed, subject to its conclusion. It is now necessary to approve the Protocol.

CONTENT: the draft Council Decision seeks the approval on behalf of the Union and its Member States, a Protocol amending the Agreement on Air Transport between Canada and the European Community and its Member States, to take account of the accession to the European Union of Croatia.

Under this Protocol, Croatia is a Party to the Agreement on Air Transport signed by Canada and the European Community and its Member States on 17 December 2009.

NON-LEGISLATIVE ACT: Council Decision (EU) 2019/704 on the conclusion, on behalf of the Union and its Member States, of a Protocol amending the Agreement on Air Transport between Canada and the European Community and its Member States, to take account of the accession to the European Union of the Republic of Croatia. CONTENT: the Council adopted a Decision on the approval, on behalf of the Union, of the Protocol amending the Air Transport Agreement between Canada and the European Community and its Member States to take account of Croatia's accession to the European Union. The EU-Canada Air Transport Agreement was initialled on 30 November 2008, endorsed by the EU-Canada summit on 6 May 2009, signed on 17-18 December 2009; subject to its conclusion at a later date. The Agreement is a comprehensive air transport agreement that includes a gradual phasing-in of traffic rights and investment opportunities, as well as a far reaching cooperation on a number of issues including safety, security, social matters, consumer interests, environment, air traffic management, state aids and competition. The Protocol was signed subject to its conclusion. Under this Protocol, Croatia becomes a party to the Agreement. The Protocol outlines the linguistic adaptations to be made to the Agreement by reason of Croatia's accession.       CONTENT: the draft Council Decision seeks the approval on behalf of the Union and its Member States, a Protocol amending the Agreement on Air Transport between Canada and the European Community and its Member States, to take account of the accession to the European Union of Croatia.

      Under this Protocol, Croatia is a Party to the Agreement on Air Transport signed by Canada and the European Community and its Member States on 17 December 2009.

      LEGAL BASIS: Articles 100(2) and 218(6)(a) of the Treaty on the European Union (TFEU) as well as the Act of Accession of Croatia..

      CONTENT: under this proposal, the Council is requested to approve, on behalf of the European Union, the Protocol amending the Agreement on Air Transport between Canada and the European Community and its Member States, to take account of the accession to the European Union of Croatia.

      The Protocol ensures the necessary amendment to be made to the Agreement on Air Transport with Canada following the accession of Croatia to the EU on 1 July 2013. The Protocol contains the necessary linguistic adaptations of the Agreement that ensue from the accession of Croatia.
