Events
PURPOSE: to adapt Regulation (EC) No 2150/2002 on waste statistics to the regulatory procedure with scrutiny.
LEGISLATIVE ACT: Regulation (EC) No 221/2009 of the European Parliament and of the Council amending Regulation (EC) No 2150/2002 on waste statistics, as regards the implementing powers conferred on the Commission.
CONTENT: having reached agreement with the Parliament at first reading, the Council adopted Regulation (EC) No 221/2009, adapting Regulation (EC) No 2150/2002 on waste statistics to the regulatory procedure with scrutiny (comitology), introduced by Decision 2006/512/EC and intended for use with measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the codecision procedure.
In particular, the Commission should be empowered to: (i) define the proper quality evaluation criteria and the contents of the quality reports; (ii) implement the results of the pilot studies; and (iii) adapt the contents of the annexes.
ENTRY INTO FORCE: 20/04/2009.
The European Parliament adopted, under the 1st reading of the codecision procedure, a legislative resolution making an amendment to the proposal for a regulation of the European Parliament and of the Council amending Regulation (EC) No 2150/2002 on waste statistics, as regards the implementing powers conferred on the Commission. The report had been tabled for consideration in plenary by Johannes BLOKLAND (IND/DEM, NL) on behalf of the Committee on the Environment, Public Health and Food Safety. The amendment was the result of a compromise between Parliament and Council.
It specified that the Commission must finance up to 100% of the costs for conducting the pilot studies. On the basis of the conclusions of the pilot studies, the Commission shall adopt the necessary implementing measures in accordance with the regulatory procedure with scrutiny.
The Committee on the Environment, Public Health and Food Safety adopted a report drafted by Johannes BLOKLAND (IND/DEM, NL) and made one amendment to the proposal for a regulation of the European Parliament and of the Council amending Regulation (EC) No 2150/2002 on waste statistics, as regards the implementing powers conferred on the Commission. It specified that the Commission must draw up a programme for pilot studies on waste from the economic activities to be carried out by the Member States. The pilot studies will aim to develop a methodology to obtain regular data which shall be governed by the principles of Community statistics, as laid down in Article 10 of Regulation (EC) No 322/97. The Commission shall finance up to 100% of the costs for conducting the pilot studies. On the basis of the conclusions of the pilot studies, the Commission shall adopt the necessary implementing measures. These measures will be adopted in accordance with the regulatory procedure with scrutiny.

CONTENT: The purpose of the adjustment is to introduce the new regulatory procedure with scrutiny into Regulation (EC) No 2150/2002, as provided for in Article 5a of Decision 1999/468/EC as amended (reform of comitology procedures).
The Commission has carefully examined all the instruments adopted by co-decision in order to identify those which permit the Commission to adopt measures of general scope designed to amend non-essential elements of the basic instrument in question. The Commission has identified more than 200 instruments that should be adjusted. Some of these instruments come under the Commission's codification programme. One of these is Regulation (EC) No 2150/2002 on waste statistics.
In this particular case, Regulation (EC) No 2150/2002 stipulates that the Commission may define the proper quality evaluation criteria and the contents of the quality reports, implement the results of the pilot studies and adapt the contents of the annexes. Since these measures are of general scope and seek to amend non-essential elements of Regulation (EC) No 2150/2002, including by supplementing it by the addition of new non-essential elements, they should be adopted in accordance with the regulatory procedure with scrutiny provided for in Article 5a of Decision 1999/468/EC.

Proposal for a regulation – amending act Article 1 - point 3 Rozporządzenie (WE) nr 2150/2002 Article 5(4)? Article 5(4) is replaced by the following: "4. On the basis of the conclusions of the pilot studies, the Commission shall inform the European Parliament and the Council of the possibilities of compiling statistics for the activities and characteristics covered by the pilot studies for import, transfer and export of waste. The Commission shall adopt the necessary implementation measures.
