1. The European Technical Assessment (ETA) shall be issued by a Technical Assessment Body, for any construction product which is not covered by a harmonised standard, at the request of a manufacturer or importer on the basis of a EAD in accordance with the procedure set out in Annex II.

(26a) Directive 2002/22/EC is without prejudice to reasonable network management by providers for example to address congestion, capacity constraints, to ensure the security of the network and of the users and to enable reliable performance of individual services, as long as this does not hinder the competitive development of the information society.
